DearFur ("DearFur," "we," "us," or "our") operates the website located at dearfur.com (the "Site") and all related information, content, features, tools, products and services (collectively, the "Services"), to provide you, the customer, with a curated shopping experience for pet products. DearFur is a sole proprietorship based in Jacksonville, Florida, United States. Our Services are powered by Shopify, which enables us to operate the Site and process transactions.

This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase using the Services, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described herein.

1. Geographic Scope

The Services are intended for use by residents of the United States only. We do not target or knowingly market, sell, or ship products to residents of the European Economic Area, the United Kingdom, Switzerland, or any other jurisdiction outside the United States. If you are accessing the Services from outside the United States, please do not provide any personal information to us. The General Data Protection Regulation (GDPR) and the UK Data Protection Act 2018 are not intended to apply to our Services, and we do not offer Services to data subjects in those jurisdictions.

2. Personal Information We Collect

When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you. Personal information does not include information that is collected anonymously or that has been de-identified. We may collect or process the following categories of personal information, depending on how you interact with the Services:

  • Financial information — payment card information, financial account information, transaction details, form of payment, and payment confirmation. Payment card details are processed directly by Shopify Payments or our payment processors; we do not store full payment card numbers on our systems.
  • Account information — if you create an account, your username, password, security questions, preferences, and settings.
  • Transaction information — the items you view, put in your cart, add to your wishlist, or purchase, return, exchange, or cancel, and your past transactions.
  • Communications with us — the content of emails, chat messages, reviews, and other communications you send to us or post on the Services.
  • Device and usage information — information about your device, browser, operating system, IP address, referring URLs, pages viewed, time spent, clicks, and other interactions with the Services.
  • Location information — general location inferred from your IP address (e.g., country, state, city). We do not collect precise geolocation unless you explicitly provide it.
  • Marketing preferences — your consent status for email marketing and targeted advertising.

Sensitive personal information. We do not intentionally collect sensitive categories of personal information such as Social Security numbers, driver's license numbers, precise geolocation, racial or ethnic origin, religious beliefs, health information, sexual orientation, or genetic or biometric data. If you are a resident of Texas or Nebraska and you voluntarily provide us with sensitive personal information, we will obtain your opt-in consent before processing it.

3. Sources of Personal Information

We collect personal information from the following sources:

  • Directly from you — when you create an account, place an order, sign up for our email list, contact customer support, post a review, or otherwise interact with the Services;
  • Automatically through the Services — through cookies, pixels, and similar technologies when you visit the Site or interact with our emails (see Section 8 below);
  • From our service providers — including Shopify, payment processors, shipping carriers, email platforms, analytics providers, and advertising partners;
  • From marketing and advertising partners — including Meta (Facebook/Instagram), Google, TikTok, and influencer or affiliate partners.

4. How We Use Your Personal Information

We use personal information for the following purposes:

  • To provide the Services — to process your payments, fulfill and ship your orders, arrange returns and exchanges, manage your account, provide customer support, enable reviews, and deliver purchased products.
  • To personalize and improve the Services — to remember your preferences, recommend products, and improve the design and functionality of the Site.
  • For marketing and advertising — to send you promotional emails (with your consent), to show you personalized advertisements on third-party platforms such as Meta, Instagram, TikTok, Google, and Pinterest, and to measure the effectiveness of our marketing.
  • For security and fraud prevention — to authenticate accounts, detect and prevent fraudulent transactions, chargebacks, abuse of our Services, and violations of our Terms of Service.
  • To communicate with you — including transactional communications (order confirmations, shipping updates, customer support responses) and, with your consent, marketing communications.
  • For legal and compliance purposes — to comply with applicable laws (including sales tax and consumer protection laws), respond to lawful requests from government authorities, enforce our Terms of Service, and protect our rights and the rights of others.

5. How We Disclose Personal Information

In the preceding 12 months, we have disclosed the following categories of personal information to the following categories of recipients for the following business purposes:

  • Shopify — our e-commerce platform provider, which hosts the Site and processes transactions on our behalf.
  • Payment processors (such as Shopify Payments, Shop Pay, PayPal, Apple Pay, Google Pay) — to process your payments.
  • Shipping carriers and fulfillment partners (such as USPS, UPS, FedEx, and our suppliers CJ Dropshipping and TopDawg) — to ship your orders.
  • Email marketing providers (such as Klaviyo) — to send marketing and transactional communications on our behalf.
  • Analytics providers (such as Google Analytics and Shopify Analytics) — to understand how visitors use the Site.
  • Advertising partners (such as Meta, Google Ads, TikTok, Pinterest) — to deliver personalized advertisements. Some of this activity may be considered a "sale" or "sharing" of personal information under certain U.S. state privacy laws. See Section 10 for your opt-out rights.
  • Customer review platforms (such as Judge.me or Loox) — to collect and display product reviews.
  • Professional advisors — including accountants, lawyers, and auditors, when necessary for business purposes.
  • Government authorities — when required by law, subpoena, or court order, or to protect our rights or the rights of others.
  • Acquirers — in the event of a business sale, merger, reorganization, or bankruptcy, personal information may be transferred as part of the transaction.

We do not sell personal information in exchange for monetary consideration. However, certain uses of advertising and analytics cookies may be considered a "sale" or "sharing" of personal information under the California Consumer Privacy Act (CCPA) and similar state laws. You can opt out of this activity as described in Section 10.

6. Relationship with Shopify

The Services are hosted by Shopify Inc. ("Shopify"), which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services. Information you submit to the Services is transmitted to and shared with Shopify and its sub-processors, some of which may be located outside the United States, in order to provide and improve the Services.

In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data from your interactions with our Site, with other Shopify merchants, and with Shopify itself. To provide these enhanced features, Shopify makes use of personal information collected about your interactions across our store and other Shopify merchants. In these circumstances, Shopify is responsible for the processing of your personal information, including responding to requests to exercise your rights over that data.

7. Third-Party Websites and Links

The Services may contain links to websites or other online platforms operated by third parties. If you follow these links, you should review their own privacy and security policies. We are not responsible for the privacy or security practices of such third-party sites, the accuracy of information they provide, or the content they display. Our inclusion of a link does not, by itself, imply any endorsement of the content, owner, or operator of that third-party site, except as expressly disclosed on the Services.

8. Cookies and Tracking Technologies

We and our service providers and advertising partners use cookies, pixels, web beacons, software development kits (SDKs), and similar technologies (collectively, "cookies") on the Services. Cookies help us operate the Site, remember your preferences, understand how visitors use the Site, and deliver relevant advertisements.

We use the following categories of cookies:

9. Email Marketing

If you provide your email address to us and consent to receive marketing communications (for example, by checking a box at checkout or subscribing to our newsletter), we may send you promotional emails about products, sales, and content we think you will enjoy. You can unsubscribe at any time by clicking the "unsubscribe" link at the bottom of any marketing email, or by contacting us at hello@dearfur.com. We will honor your unsubscribe request promptly, and in any event within ten (10) business days as required by the CAN-SPAM Act. Even if you unsubscribe from marketing emails, we may still send you transactional communications related to your orders, account, or customer service inquiries.

10. Your Rights and Choices

Depending on where you reside, you may have some or all of the rights listed below. These rights are not absolute and may be subject to verification or legal exceptions.

  • Right to know / access — You may request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for which it is used, and the third parties with whom we share it.
  • Right to delete — You may request that we delete personal information we maintain about you, subject to certain exceptions.
  • Right to correct — You may request that we correct inaccurate personal information we maintain about you.
  • Right to portability — You may request a copy of the personal information we hold about you in a portable, machine-readable format, in certain circumstances.
  • Right to opt out of the sale or sharing of personal information, including for targeted advertising — You may opt out of the "sale" or "sharing" of your personal information, or its processing for targeted advertising, at this link.
  • Right to non-discrimination — We will not discriminate against you for exercising any of these rights.

Global Privacy Control. If you visit our website with the Global Privacy Control (GPC) opt-out preference signal enabled, we will automatically treat this as a request to opt out of the sale or sharing of personal information for the browser and device you are using. Do Not Track. Our Site responds to the Global Privacy Control signal described above. We do not respond to other browser-based "Do Not Track" signals at this time, as there is no consistent industry or legal standard for those signals. This disclosure is provided pursuant to the California Online Privacy Protection Act (CalOPPA).

How to exercise your rights. You can exercise your rights by contacting us at hello@dearfur.com or by using the opt-out link above. We may need to verify your identity before processing your request, for example by asking you to confirm information associated with your order or account. You may designate an authorized agent to submit requests on your behalf; we may require verification that the agent is authorized and may also require verification of your identity directly with us. We will respond to your request within the timeframe required by applicable law.

11. Children's Data

The Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us at hello@dearfur.com and we will take steps to delete the information. As of the effective date of this Privacy Policy, we do not have actual knowledge that we "sell" or "share" (as those terms are defined under applicable law) the personal information of any individual under 16 years of age.

12. Security of Your Information

We take reasonable administrative, technical, and physical measures designed to protect personal information from unauthorized access, use, or disclosure. These measures include the security measures provided by Shopify, which is a PCI DSS compliant e-commerce platform, and encryption of payment information in transit. However, no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." Any information you send to us may not be fully secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

If you create an account, you are responsible for keeping your credentials safe. We recommend that you use a strong, unique password and that you do not share your credentials with anyone.

13. Retention of Your Information

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. In general:

  • Order and transaction records — retained for a minimum of seven (7) years to comply with tax and accounting obligations.
  • Account information — retained while your account is active and for a reasonable period after deactivation, unless you request earlier deletion.
  • Marketing preferences and consent records — retained for as long as we contact you for marketing and for a reasonable period after you opt out, to honor your opt-out preference.
  • Customer support communications — retained for up to three (3) years.
  • Analytics and advertising data — retained in accordance with the retention settings of our service providers (typically 14–26 months for Google Analytics).

After the applicable retention period, we will delete or anonymize your personal information, except where retention is required by law or necessary to resolve disputes or enforce our agreements.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, our Services, or applicable law. When we make material changes, we will update the "Last updated" date at the top of this Privacy Policy and, where required by law, provide additional notice (such as by email or a prominent notice on the Site). Your continued use of the Services after the effective date of any revised Privacy Policy constitutes your acceptance of the revised terms.
